FirstPitch provides an AI-powered video prospecting platform that enables users to create, personalise, and send video messages at scale. The Service includes video recording, AI personalisation, analytics, and integrations with third-party platforms.

3. Account Registration

To use the Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access
  • Be at least 18 years old or have parental consent

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Send spam, unsolicited messages, or harass others
  • Impersonate any person or entity
  • Upload malicious code or interfere with the Service

5. Content Ownership

6. Payment Terms

  • Paid subscriptions are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days' notice
  • You are responsible for all applicable taxes
  • Failed payments may result in service suspension

7. API and Integration Terms

If you use our API or integrations:

  • You must comply with our API documentation
  • Rate limits and usage quotas apply
  • API access may be revoked for misuse
  • You may not resell API access without authorization

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIRSTPITCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

10. Indemnification

You agree to indemnify and hold harmless FirstPitch from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account at any time for violations of these Terms. You may cancel your account at any time through your account settings. Upon termination, your right to use the Service will cease immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
